Terms of Service

By commissioning me in any kind of way, you are agreeing to the following terms of service. 

Any statement can be bound to change if discussed with me (Kia Jane), the artist, before the commission. 

 

GENERAL TERMS 
  • Please write clearly and politely when communicating. 
  • Provide clear references when required. 
  • Any ill behaviour will not be tolerated and your commission will be cancelled if it occurs. 
  • I, the artist, have the right to decline or cancel a commission for any reason. 
  • Commission prices are subject to change, but price changes will not apply if a client is in the queue for a commission and they made their commission request before the changes took place. 
  • Clients must state whether their commission will be used solely for personal use or if they intend to use it commercially and potentially profit from the work. Commercial work will always incur an additional fee. 
  • Clients must state whether or not they would like their commission to remain private. Private commissions can incur an additional fee.  
  • If a client requests a commission that has a deadline of a week or less, rush fees may apply.  

 

PAYMENT 
  • All commissions must be paid in full, or an agreement can be made for the amount to be paid 50% upfront and 50% when the pencil/sketch phase is confirmed to be satisfactory. Deposits can be discussed with myself, the artist, until the pencil/sketch phase is complete, then full payment must be received.  
  • The client is responsible for full payment of the artwork and shipping. This is non-negotiable.
  • The only currency accepted is GBP. 
  • Payment can only be made via PayPal or Stripe. 
  • Payment cannot be made in the form of cash/ cheque.  

 

PROCESS 
  • The client must provide a clear idea of the work they would like and the size of the canvas. The artist will then provide them with the rate if not predetermined by the 'Custom Portrait' listings.  
  • The client must provide a clear photo reference image as required.  
  • Work will be started once either full payment has been received or 50% payment has been received. I, the artist, will confirm with the client when the payment has been received.  
  • Work In Progress will be given to the client in the form of a low-resolution JPG after each phase. 
  • If the client has decided to pay 50% upfront, the other 50% must be paid once they have confirmed with the artist that the pencil/sketch is ready for ink/colour. Inking will be started once the artist has confirmed with the client that the full payment has been received.  
  • Time-consuming changes (remissions) will incur an additional fee. The first small change (examples – changing hair colour, facial features etc.) is free. Additional small changes will require an additional charge of 15% of the full price (for example – a small change to a £100 commission will cost £15). Large changes (examples – pose/panel redraws, a change in appearance, etc.) will require an additional charge of 20% of the full price (example – a large change to a £100 commission will cost £20) and can only take place within the pencil sketch or ink/line art phase. Never after the colour stage has taken place. Change fees must be made upfront when a change is requested. Changes will not be made until the artist has confirmed that the payment has been received.  
  • If the client is commissioning multiple pieces (examples – a comic, a poster series, etc.) the client can either choose to pay the entire project upfront/50-50, or choose to pay upfront/50-50 on a piece-by-piece basis.  
  • Work will be started as soon as possible once payment has been received. The artist will inform the client if there is a queue for commissioned work and will keep them informed of their place in line.  
  • The client will be sent a high-resolution JPG of the finished commission to ensure every detail is to their specifications and will be sent to the client via the Royal Mail service, upon receiving the client's satisfaction of the piece.  

SHIPPING
  • All items will be shipped with Royal Mail as Tracked First Class Delivery. This tracking code will be kept by the artist and will be provided to the client so both parties can follow the parcel. 
  • If the item does not arrive but has been successfully delivered via the tracking, no refund or replacement will be sent. 
  • If, upon receiving the artwork, the client then wishes to return the piece, a return address will be provided but shipping costs must be covered by the artist. 

 

CUSTOMER SATISFACTION 
  • I, the artist, will do everything I can to make my clients happy. 
  • However, changes cannot be made after the work is completed and the client has received their high-resolution file via email. 
  • I, the artist, ask that the client be clear with what they would like from the beginning to avoid any major issues and minimize the chance of needing any changes made. 

 

COPYRIGHT/ USAGE POLICY 
  • I, the artist, hold every right to the produced artwork, not the client.  

Therefore, I am allowed to use the artwork to: 

  • Promote my services. 
  • Display it anywhere to my liking.  
  • Post it to any platform at my discretion. 

The client is allowed to: 

  • Use the copyrighted artwork for personal use only unless agreed otherwise. 
  • Claim the right to the object within the painting, but not the painting itself.  
  • Share the artwork on their social media pages and/or use the art to promote themselves with the proper credit given to the artist. 

If you break the copyright infringement in any way, every right you had to the painting will be revoked and any further infractions will incur legal proceedings.  

 

The following is considered copyright infringement: 

  • Reproducing/using the copyrighted artwork commercially. 
  • Taking credit for the creation of the artwork. 
  • Removing any watermarks/signatures.  
  • Altering the artwork without my, the artist's, consent.  

A purchase of Commercial rights to the artwork will always be 300% of the original price.  

With commercial rights, you are allowed to make any sort of merchandise with the artwork.  

Use it in books, covers, as props, change it to your liking and promote your brand.  

Credit is still required for usage of the artwork, even if altered or edited.  

Private commissions of the above nature will always incur a 50% fee.  

 CANCELLATIONS/REFUNDING POLICY

  • I, the artist, have the right to cancel and refund the money for your commission at any time.  
  • The client may only request a cancellation and refund during the pencil/sketch phase.  
  • If cancellation is requested during the ink/colour phase, no refund will be given.  
  • If cancellation and refund are requested, the artist will refund 50% of any payments up until that point.  
  • 100% refunds will never be made once the work has been started.  
  • If payment has not yet been made the client has the right to cancel the commission.  

 

  • If you file a chargeback against me, your right to everything I have ever made you will be retracted and I have the right to sell the copyrighted artwork to a new buyer. 
  • You will be forbidden to ever commission me, Kia Jane, ever again.  

Any statement can be bound to change if discussed with me, the artist before the commission starts.
